Power of Attorney

An Enduring Power of Attorney is granted by an individual to normally two other people to look after their affairs and make decisions on their behalf if they themselves are not able to.  The Court can intervene to do this, however people tend to do it before they know they will need it as it is cheaper and enables them to have the choice. 

A Living Will, also known as an "advance directive" is a document which usually takes the form of a written statement setting out in advance what types of medical treatment the maker of the will does or does not desire to receive in specific circumstances, should they be incapable of giving or refusing consent.

A Living Will must be signed whilst the maker is mentally competent.
